Welcome to Aroopa Apps

1. Overview
This Anti-Spam Policy applies to all Aroopa Apps services used to send emails, messages, or other communications, including but not limited to email, SMS, and thirdparty messaging integrations (“Covered Services”)
By using Aroopa Apps, you agree to comply with this Policy, our Terms and Conditions, and all applicable laws.
Aroopa maintains a strict zero-tolerance policy toward spam.
Violation may result in:
  • Immediate suspension or termination of your account 
  • Blocking of messaging capabilities
  • Legal action where applicable

2. Applicability to SaaS Clients (Tenants)

Aroopa Apps operates as a multi-tenant SaaS platform.

Each Client (“Tenant”) is solely responsible for:
  • All communications sent through the platform
  • Recipient data and consent management
  • Compliance with applicable anti-spam and data protection laws

Aroopa acts only as a technology provider and does not initiate, control, or approve communications sent by Clients.

3. What Constitutes Spam

Spam includes, but is not limited to:

  • Sending messages without valid consent
  • Sending unsolicited bulk communications
  • Using purchased, rented, or scraped contact li
  • Sending misleading or deceptive messages
  • Ignoring unsubscribe or opt-out requests

Even if legally ambiguous, any activity that results in high complaint rates may be treated as spam.

4. Consent Requirements (“Permission”)

You may only send communications to individuals who have provided clear, informed, and verifiable consent.

Acceptable Forms of Consent:

  • Opt-in via website forms (unchecked by default)
  • Newsletter subscriptions with clear disclosure
  • Purchase or service sign-up with explicit marketing consent
  • Event registrations with communication disclosure
  • Business card exchange with implied B2B communication (limited use)
Invalid Consent:
  • Purchased or third-party lists
  • Scraped or publicly collected emails
  • Pre-checked consent boxes
  • Generic or implied consent without clear disclosure

Consent must be:

  • Freely given
  • Specific
  • Informed
  • Unambiguous
5. Proof of Consent

You must maintain verifiable records of consent, including:

  • Source of opt-in
  • Date and time
  • Method of consent capture
  • IP address or system logs (where applicable)

Aroopa reserves the right to request proof of consent at any time.

Failure to provide proof may result in immediate suspension.

6. Mandatory Messaging Requirements

All communications sent via Aroopa Apps must:

  • Clearly identify the sender (your business/entity name)
  • Include a valid physical mailing address
  • Contain a clear and non-deceptive subject line
  • Provide a visible and functional unsubscribe mechanism
  • Honor opt-out requests within 10 days (or sooner where required by law)
7. Unsubscribe & Opt-Out Compliance

You must:

  • Provide a one-click unsubscribe option (where applicable)
  • Respect opt-out requests immediately
  • Maintain suppression lists to prevent re-contact

Once a recipient opts out:

You must not contact them again unless fresh consent is obtained.

8. Prohibited Activities

You may NOT use Aroopa Apps to:

  • Send spam or unsolicited bulk messages
  • Use misleading headers, domains, or identities
  • Conduct phishing, fraud, or deceptive campaigns
  • Send malware, harmful links, or unsafe content
  • Circumvent unsubscribe mechanisms
  • Reuse suppressed or opted-out contacts
9. Global Compliance Obligations

Clients must comply with all applicable laws, including:

  • GDPR (EU/UK)
  • CAN-SPAM Act (USA)
  • CASL (Canada)
  • CCPA/CPRA (California)
  • DPDP Act, 2023 (India)
  • Any other applicable regional regulations

Non-compliance is solely the responsibility of the Client.

10. Monitoring and Enforcement

While Aroopa does not routinely monitor content, we may:

  • Investigate complaints or suspicious activity
  • Monitor usage patterns (e.g., bounce rates, spam complaints)
  • Suspend or restrict accounts proactively

We reserve the right to take action without prior notice.

11. Third-Party Integrations

If you use third-party tools (e.g., email gateways, WhatsApp APIs):

  • You must comply with their policies as well
  • Aroopa is not responsible for third-party violations or restrictions
12. Consequences of Violations

Violations may result in:

  • Warning or compliance notice
  • Temporary suspension
  • Permanent account termination
  • Reporting to regulatory authorities (if required)

No refunds will be provided for terminated accounts due to violations.

13. Reporting Spam or Abuse

If you receive spam or suspect misuse of Aroopa Apps:

We will investigate and take appropriate action.

14. Policy Acceptance

By using Aroopa Apps Covered Services, you acknowledge and agree to this Anti-Spam Policy.
